DIANA STAINTON PHOTOGRAPHY — TERMS & CONDITIONS

By booking a shoot with the Photographer, Diana Stainton, you agree to the terms & conditions below.

USAGE
The images the Photographer supplies are licensed for the sole use of the Client only, for their own marketing, social media, and e-commerce purposes. The images may not be used by a third party (including PR agencies, retailers, or other brands) for advertising purposes without prior written agreement. The images must not be sold on for profit.

Permission to use the images for purposes outside the terms stated above will be granted for an additional fee.

BOOKINGS
Bookings are for one brand, unless otherwise agreed.

COPYRIGHT
The copyright of all photography remains with the Photographer for every shoot.

The Client assigns to the Photographer the irrevocable and unrestricted right to use and publish photographs for editorial, advertising, educational materials, and any other purpose for promotional purposes of the Photographer, including but not limited to website portfolio, social media, and printed materials.

ARTIFICIAL INTELLIGENCE (AI)
The images supplied by the Photographer may not be used as source material for AI image generation, editing, or training tools. This includes but is not limited to:

- Using photographs as a base layer for AI-edited versions (e.g. swapping products, backgrounds, or subjects)

- Inputting images into generative AI tools

- Using images to train, fine-tune, or develop AI models

The Photographer may, at her discretion, issue a separate AI licence permitting specific uses of the images in connection with AI tools. This licence is available for an additional fee and must be agreed in writing prior to any such use. Please get in touch to discuss your requirements.

FILES
The Photographer will supply sRGB high resolution and web-sized JPEGs. TIFFs are supplied on request. Raw files are not supplied.

DELIVERY
The cost of delivery and returns is the responsibility of the Client. In the unlikely event that products go missing in transit, it is the responsibility of the Client to claim with the courier. Products need to arrive 2–3 days before the shoot date if being posted.

PRODUCTS
If you are waiting for a first run of samples to be made, please allow a buffer for delays in production or amendments, especially if samples are coming from abroad. I would suggest booking a photoshoot 2 weeks after samples are due to arrive.


Please pack products well with sufficient packaging and bubblewrap to protect each item. Products must arrive in good condition, clean, and quality controlled by the Client prior to the shoot. The Photographer is not responsible for incorrect or damaged samples.

COLOURWAYS

Each colourway counts as one product. For example, 5 products in 5 colourways equals 25 products.

CUTOUTS
Cutouts are supplied on a white background as a JPEG. Clipping paths are supplied on request.

DEPOSIT / CANCELLATION
A 50% deposit is taken to secure the booking date. This covers admin time and studio running costs. Deposits are non-refundable in the event of cancellation as they cover loss of income.

2 weeks' notice is required to move a booking date (not applicable for mini shoots, where the date is set). If you need to change the shoot date with less than 2 weeks' notice, or the products don't arrive on time, a £50 admin fee applies.

Please ensure products are ready at least two weeks prior to the shoot and allow extra time if you have not seen samples in case amendments are needed or there are manufacturing delays.

If the Photographer has to cancel this contract for reasons beyond her control (e.g. death, injury, sickness), a full refund will be granted.

DELAYS
Please arrive promptly for your photoshoot slot and allow extra time in case of traffic. If you arrive late for your time slot, I will not be able to add extra time onto the end of the shoot.

AMENDMENTS / EXTRA IMAGE PROCESSING
Amendments can be made upon request. One hour of processing time is included in the fee for product shots. If there are a large number of images to process, advanced retouching is required, or amendments are requested after files are delivered, the fee is £40 per hour.

STYLE
You are booking Diana Stainton on the basis that you like her style of photography. A range of examples is available on the website. If you don't see a style you like, I am most likely not the best match for you — I say this because I want businesses to get exactly what they need from a photoshoot.

After receiving a moodboard, I will light and style images with my own creative interpretation. I do not offer refunds if images are rejected on the basis of style, composition, or lighting. I will, however, do my best to resolve any issues on the day of the shoot. If you grant me creative freedom, no refunds will be given on the basis of style.

TURNAROUND
My typical turnaround time is one week (7 days) from the photoshoot date.

SELECTION
I do not supply all images taken during a photoshoot. For product shoots, we style to the crop needed and select the best final shot of each scene as we shoot. Model shoots are faster paced, so I send a contact sheet of images for the Client to select from.
